Please note that data transmission over the internet (e.g., communication via email) can have security gaps. A complete protection of data from access by third parties is not possible.

Note on the Responsible Party

The responsible party for data processing on this website is:

MD Studios | Dennis Langthaler

The responsible party is the natural or legal person who alone or jointly with others determines the purposes and means of processing personal data (e.g., names, email addresses, etc.).

Storage Duration

Unless a more specific storage duration is mentioned in this privacy policy, your personal data will remain with us until the purpose for processing is fulfilled. If you make a valid deletion request or revoke consent to data processing, your data will be deleted unless we have other legally permissible reasons to store your personal data (e.g., tax or commercial retention periods); in the latter case, deletion will occur after the reason for retention has ended.

General Information on the Legal Basis for Data Processing on this Website

If you have consented to data processing, we process your personal data based on Art. 6 Para. 1 lit. a GDPR or Art. 9 Para. 2 lit. a GDPR, if special categories of data are processed under Art. 9 Para. 1 GDPR. In the case of explicit consent to the transfer of personal data to third countries, data processing is also carried out based on Art. 49 Para. 1 lit. a GDPR. If you have consented to the storage of cookies or the access to information on your device (e.g., via device fingerprinting), data processing is additionally based on § 25 Para. 1 TTDSG. Consent can be revoked at any time. If your data is necessary for the fulfillment of a contract or for the implementation of pre-contractual measures, we process your data based on Art. 6 Para. 1 lit. b GDPR. Furthermore, we process your data if required to fulfill a legal obligation based on Art. 6 Para. 1 lit. c GDPR. Data processing may also occur based on our legitimate interest pursuant to Art. 6 Para. 1 lit. f GDPR. The relevant legal bases for each case will be outlined in the following sections of this privacy policy.

Note on data transfer to the USA and other third countries

We use tools from companies based in the USA or other third countries that do not provide adequate data protection. When these tools are active, your personal data may be transferred to and processed in these third countries. We would like to point out that these countries cannot guarantee a level of data protection comparable to that of the EU. For example, US companies are required to disclose personal data to security authorities without you, as the data subject, being able to take legal action against it. Therefore, it cannot be ruled out that US authorities (e.g., intelligence agencies) may process, analyze, and permanently store your data located on US servers for surveillance purposes. We have no influence over these processing activities.

Recipients of personal data

As part of our business activities, we collaborate with various external parties. In some cases, it is necessary to transfer personal data to these external parties. We only disclose personal data to external parties if this is required for the fulfillment of a contract, if we are legally obliged to do so (e.g., transferring data to tax authorities), if we have a legitimate interest in the transfer under Article 6(1)(f) GDPR, or if another legal basis permits the data transfer. When using processors, we only share personal data of our customers based on a valid data processing agreement. In the case of joint processing, a joint processing agreement is concluded.

Withdrawal of Your Consent to Data Processing

Many data processing operations are only possible with your explicit consent. You can withdraw your consent at any time. The legality of the data processing carried out up until the withdrawal remains unaffected by the withdrawal.

Right to object to data collection in specific cases as well as to direct marketing (Article 21 GDPR)

IF THE DATA PROCESSING IS BASED ON ARTICLE 6 PARAGRAPH 1 LIT. E OR F OF THE GDPR, YOU HAVE THE RIGHT TO OBJECT AT ANY TIME, ON GROUNDS ARISING FROM YOUR PARTICULAR SITUATION, TO THE PROCESSING OF YOUR PERSONAL DATA; THIS ALSO APPLIES TO PROFILING BASED ON THESE PROVISIONS. THE LEGAL BASIS FOR A PARTICULAR PROCESSING IS PROVIDED IN THIS PRIVACY POLICY. IF YOU OBJECT, WE WILL NO LONGER PROCESS YOUR AFFECTED PERSONAL DATA, UNLESS WE CAN DEMONSTRATE COMPELLING LEGITIMATE GROUNDS FOR THE PROCESSING THAT OVERRIDE YOUR INTERESTS, RIGHTS, AND FREEDOMS, OR THE PROCESSING IS NECESSARY FOR THE ESTABLISHMENT, EXERCISE, OR DEFENSE OF LEGAL CLAIMS (OBJECTION UNDER ARTICLE 21 PARAGRAPH 1 GDPR).

IF YOUR PERSONAL DATA IS PROCESSED FOR THE PURPOSE OF DIRECT MARKETING, YOU HAVE THE RIGHT TO OBJECT AT ANY TIME TO THE PROCESSING OF YOUR PERSONAL DATA FOR SUCH MARKETING PURPOSES; THIS ALSO APPLIES TO PROFILING TO THE EXTENT THAT IT IS RELATED TO SUCH DIRECT MARKETING. IF YOU OBJECT, YOUR PERSONAL DATA WILL NO LONGER BE USED FOR DIRECT MARKETING PURPOSES (OBJECTION UNDER ARTICLE 21 PARAGRAPH 2 GDPR).

Right to lodge a complaint with the competent supervisory authority

In the event of violations of the GDPR, data subjects have the right to lodge a complaint with a supervisory authority, particularly in the member state of their habitual residence, their place of work, or the place of the alleged infringement. The right to lodge a complaint is without prejudice to other administrative or judicial remedies.

Right to data portability

You have the right to request the transfer of data that we process automatically based on your consent or in fulfillment of a contract, either to yourself or to a third party in a commonly used, machine-readable format. If you request the direct transfer of the data to another controller, this will only be done if technically feasible.

Access, Correction, and Deletion

You have the right, in accordance with applicable legal provisions, to request free information about your stored personal data, their origin, recipients, and the purpose of processing, as well as, if applicable, the right to correct or delete this data. You can contact us at any time for this purpose or for any further questions regarding personal data.

Right to Restrict Processing

You have the right to request the restriction of the processing of your personal data. You can contact us at any time to exercise this right. The right to restrict processing exists in the following cases:

  • If you dispute the accuracy of your personal data stored with us, we generally need time to verify this. During the verification period, you have the right to request the restriction of the processing of your personal data.

  • If the processing of your personal data is unlawful, you may request the restriction of processing instead of deletion.

  • If we no longer need your personal data, but you require it for the exercise, defense, or assertion of legal claims, you have the right to request the restriction of the processing of your personal data instead of deletion.

  • If you have filed an objection under Art. 21 (1) GDPR, an assessment must be made between your interests and ours. As long as it is not clear whose interests prevail, you have the right to request the restriction of the processing of your personal data.

If you have restricted the processing of your personal data, these data—apart from being stored—may only be processed with your consent or for the establishment, exercise, or defense of legal claims, for the protection of the rights of another natural or legal person, or for reasons of important public interest of the European Union or a Member State.

SSL or TLS Encryption

This site uses SSL or TLS encryption for security reasons and to protect the transmission of confidential content, such as orders or inquiries that you send to us as the website operator. You can recognize an encrypted connection by the fact that the browser's address bar changes from "http://" to "https://" and by the lock symbol in your browser's address bar.

If SSL or TLS encryption is enabled, the data you transmit to us cannot be read by third parties.

Encrypted payment transactions on this website

If you are required to provide us with your payment details (e.g., account number for direct debit) after entering into a paid contract, these details are necessary for payment processing.

Payment transactions using common payment methods (Visa/MasterCard, direct debit) are carried out exclusively via an encrypted SSL or TLS connection. You can recognize an encrypted connection by the fact that the browser’s address bar changes from “http://” to “https://” and by the lock symbol in your browser bar.

With encrypted communication, your payment data that you transmit to us cannot be read by third parties.

4. Data Collection on This Website

Cookies

Our website uses so-called "cookies." Cookies are small data packets that do not cause any harm to your device. They are either stored temporarily for the duration of a session (session cookies) or permanently (persistent cookies) on your device. Session cookies are automatically deleted after your visit. Persistent cookies remain stored on your device until you delete them yourself or your web browser automatically removes them.

Cookies may be set by us (first-party cookies) or by third-party companies (third-party cookies). Third-party cookies enable the integration of certain services provided by external companies (e.g., cookies used for processing payment services).

Cookies serve various functions. Many cookies are technically necessary because certain website functions would not work without them (e.g., shopping cart functionality or video display). Other cookies may be used to analyze user behavior or for advertising purposes.

Cookies that are essential for carrying out electronic communication processes, providing specific functions requested by you (e.g., shopping cart functionality), or optimizing the website (e.g., cookies used to measure web traffic) are stored based on Art. 6(1)(f) GDPR, unless another legal basis is specified. The website operator has a legitimate interest in storing necessary cookies to ensure the technically error-free and optimized provision of its services. If consent for storing cookies or similar recognition technologies has been requested, processing is based solely on this consent (Art. 6(1)(a) GDPR and § 25(1) TTDSG); consent can be revoked at any time.

You can configure your browser to inform you about the use of cookies, allow cookies only in specific cases, block cookies for certain scenarios or in general, and enable the automatic deletion of cookies when closing your browser. If cookies are disabled, the functionality of this website may be limited.

Details on which cookies and services are used on this website can be found in this privacy policy.

Contact Form

If you send us inquiries via the contact form, the information you provide in the inquiry form, including the contact details you enter there, will be stored by us for the purpose of processing the inquiry and in case of follow-up questions. We do not share this data without your consent.

The processing of this data is based on Article 6(1)(b) GDPR if your request is related to the fulfillment of a contract or is necessary for the implementation of pre-contractual measures. In all other cases, processing is based on our legitimate interest in the effective handling of inquiries addressed to us (Article 6(1)(f) GDPR) or on your consent (Article 6(1)(a) GDPR) if this was requested; consent can be revoked at any time.

The data you enter in the contact form will remain with us until you request deletion, revoke your consent to storage, or the purpose for data storage no longer applies (e.g., after completing the processing of your request). Mandatory statutory provisions – especially retention periods – remain unaffected.

Inquiry via Email, Telephone, or Fax

If you contact us via email, telephone, or fax, your inquiry, including all resulting personal data (name, inquiry), will be stored and processed by us for the purpose of handling your request.

The data you send to us via contact inquiries will remain with us until you request deletion, revoke your consent to storage, or the purpose for data storage no longer applies (e.g., after completing the processing of your request). Mandatory statutory provisions – especially legal retention periods – remain unaffected.

Registration on this Website

You can register on this website to use additional features. The data entered during registration will only be used for the purpose of utilizing the respective offer or service for which you have registered. The mandatory fields requested during registration must be fully provided. Otherwise, we will reject the registration.

For important changes, such as changes in the scope of the offer or technically necessary changes, we will use the email address provided during registration to inform you.

The processing of the data entered during registration is carried out for the purpose of performing the user relationship established by the registration and, if applicable, for initiating further contracts (Art. 6 para. 1 lit. b GDPR).

The data collected during registration will be stored by us as long as you are registered on this website and will be deleted afterward. Statutory retention periods remain unaffected.

5. Social Media

Instagram

This website integrates features of the Instagram service. These features are provided by Meta Platforms Ireland Limited, 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland.

When the social media element is active, a direct connection is established between your device and the Instagram server. This allows Instagram to receive information about your visit to this website.

If you are logged into your Instagram account, you can link the content of this website to your Instagram profile by clicking the Instagram button. This enables Instagram to associate your visit to this website with your user account. We would like to point out that, as the provider of the pages, we have no knowledge of the content of the transmitted data or how Instagram uses them.

If consent has been obtained, the use of the aforementioned service is based on Art. 6 para. 1 lit. a GDPR and § 25 TTDSG. The consent can be revoked at any time. If no consent was obtained, the use of the service is based on our legitimate interest in achieving the most comprehensive visibility on social media.

If, with the help of the tool described here, personal data is collected on our website and transferred to Facebook or Instagram, we and Meta Platforms Ireland Limited, 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland, are jointly responsible for this data processing (Art. 26 GDPR). The joint responsibility is limited exclusively to the collection of the data and its transfer to Facebook or Instagram. The subsequent processing by Facebook or Instagram after the transfer is not part of the joint responsibility. The obligations we share have been documented in an agreement on joint processing.

The wording of the agreement can be found here: https://www.facebook.com/legal/controller_addendum.

According to this agreement, we are responsible for providing the data protection information when using the Facebook or Instagram tools and for the secure implementation of the tools on our website. Facebook is responsible for the data security of the Facebook or Instagram products. Data subject rights (e.g., requests for information) regarding the data processed by Facebook or Instagram can be asserted directly with Facebook. If you assert data subject rights with us, we are obliged to forward them to Facebook.

Data transfer to the USA is based on the standard contractual clauses of the EU Commission. For details, see here: https://www.facebook.com/legal/EU_data_transfer_addendum, https://help.instagram.com/519522125107875, and https://de-de.facebook.com/help/566994660333381.

Further information can be found in Instagram's privacy policy: https://instagram.com/about/legal/privacy/.

6. Newsletter

Newsletter Data

If you would like to receive the newsletter offered on the website, we require an email address from you, as well as information that allows us to verify that you are the owner of the provided email address and that you agree to receive the newsletter. No further data will be collected, or only on a voluntary basis. We use this data exclusively for sending the requested information and do not share it with third parties.

The processing of the data entered in the newsletter registration form is carried out exclusively based on your consent (Art. 6 para. 1 lit. a GDPR). You can withdraw the consent to store the data, the email address, and their use for sending the newsletter at any time, e.g., via the "unsubscribe" link in the newsletter. The legality of any data processing operations already carried out remains unaffected by the withdrawal.

The data you provided for receiving the newsletter will be stored by us until you unsubscribe from the newsletter, either with us or with the newsletter service provider, and will be deleted after unsubscribing from the newsletter or after the purpose no longer applies. We reserve the right to delete or block email addresses from our newsletter distribution list at our discretion in accordance with our legitimate interest pursuant to Art. 6 para. 1 lit. f GDPR.

Data stored for other purposes will remain unaffected by this.

After you unsubscribe from the newsletter distribution list, your email address may be stored with us or the newsletter service provider in a blacklist if this is necessary to prevent future mailings. The data in the blacklist will only be used for this purpose and will not be merged with other data. This serves both your interest and our interest in complying with legal requirements when sending newsletters (legitimate interest under Art. 6 para. 1 lit. f GDPR). The storage in the blacklist is not time-limited. You can object to the storage if your interests outweigh our legitimate interest.

7. Plugins and Tools

YouTube with Enhanced Privacy

This website embeds videos from YouTube. The operator of the site is Google Ireland Limited ("Google"), Gordon House, Barrow Street, Dublin 4, Ireland.

We use YouTube in enhanced privacy mode. According to YouTube, this mode ensures that YouTube does not store information about visitors to this website before they watch the video. However, the enhanced privacy mode does not necessarily exclude the sharing of data with YouTube partners. As a result, YouTube – regardless of whether you watch a video – establishes a connection to the Google DoubleClick network.

Once you start a YouTube video on this website, a connection to YouTube’s servers is established. The YouTube server is informed about which of our pages you have visited. If you are logged into your YouTube account, you allow YouTube to associate your browsing behavior directly with your personal profile. You can prevent this by logging out of your YouTube account.

Additionally, YouTube may store various cookies on your device or use comparable recognition technologies (e.g., device fingerprinting) once a video is started. In this way, YouTube can collect information about visitors to this website. This information is used, among other things, to collect video statistics, improve user-friendliness, and prevent fraud attempts.

After starting a YouTube video, further data processing operations may be triggered, over which we have no control.

The use of YouTube is in the interest of presenting our online offers in an engaging manner. This constitutes a legitimate interest pursuant to Art. 6 para. 1 lit. f GDPR. If consent has been obtained, processing will only occur on the basis of Art. 6 para. 1 lit. a GDPR and § 25 para. 1 TTDSG, to the extent that the consent includes the storage of cookies or access to information on the user's device (e.g., device fingerprinting) in accordance with the TTDSG. Consent can be revoked at any time.

For more information about privacy on YouTube, please refer to their privacy policy at: https://policies.google.com/privacy?hl=en.

Google Maps

This website uses the map service Google Maps. The provider is Google Ireland Limited ("Google"), Gordon House, Barrow Street, Dublin 4, Ireland.

To use the features of Google Maps, it is necessary to store your IP address. This information is usually transmitted to a Google server in the USA and stored there. The provider of this site has no influence over this data transfer. When Google Maps is enabled, Google may use Google Fonts for the purpose of uniform font display. When you access Google Maps, your browser loads the required web fonts into your browser cache to display text and fonts correctly.

The use of Google Maps is in the interest of an appealing presentation of our online offers and the easy findability of the locations we specify on the website. This constitutes a legitimate interest under Art. 6 para. 1 lit. f GDPR. If consent has been obtained, processing will occur solely on the basis of Art. 6 para. 1 lit. a GDPR and § 25 para. 1 TTDSG, to the extent that the consent includes the storage of cookies or access to information on the user’s device (e.g., device fingerprinting) in the sense of TTDSG. Consent can be revoked at any time.

Data transfer to the USA is based on the Standard Contractual Clauses of the EU Commission.

Details can be found here: https://privacy.google.com/businesses/gdprcontrollerterms/ and https://privacy.google.com/businesses/gdprcontrollerterms/sccs/.

For more information on the handling of user data, please refer to Google’s privacy policy: https://policies.google.com/privacy?hl=en.

Google reCAPTCHA

We use "Google reCAPTCHA" (hereinafter "reCAPTCHA") on this website. The provider is Google Ireland Limited ("Google"), Gordon House, Barrow Street, Dublin 4, Ireland.

The purpose of reCAPTCHA is to verify whether the data input on this website (e.g., in a contact form) is made by a human or by an automated program. For this purpose, reCAPTCHA analyzes the behavior of the website visitor based on various characteristics. This analysis starts automatically as soon as the website visitor enters the site. For the analysis, reCAPTCHA evaluates various information (e.g., IP address, time spent on the website, or mouse movements made by the user). The data collected during the analysis is sent to Google.

The reCAPTCHA analysis runs entirely in the background. Website visitors are not notified that an analysis is taking place.

The storage and analysis of the data is based on Art. 6 para. 1 lit. f GDPR. The website operator has a legitimate interest in protecting its web offers from abusive automated surveillance and spam.

For more information on Google reCAPTCHA, please refer to Google’s privacy policy and terms of use at the following links: https://policies.google.com/privacy?hl=en and https://policies.google.com/terms?hl=en.

Spotify

This website integrates features from the music service Spotify. The provider is Spotify AB, Birger Jarlsgatan 61, 113 56 Stockholm, Sweden. The Spotify plugins are recognizable by the green logo on this website. An overview of the Spotify plugins can be found at: https://developer.spotify.com.

This allows a direct connection between your browser and the Spotify server when you visit this website via the plugin. As a result, Spotify receives the information that you have visited this website with your IP address. If you click the Spotify button while logged into your Spotify account, you can link the content of this website to your Spotify profile. This allows Spotify to associate the visit to this website with your user account.

Please note that when using Spotify, cookies from Google Analytics are used, meaning that your usage data when using Spotify may also be shared with Google. Google Analytics is a tool from the Google group for analyzing user behavior, based in the USA. Spotify is solely responsible for this integration. As the website operator, we have no influence over this processing.

The storage and analysis of the data is based on Art. 6 para. 1 lit. f GDPR. The website operator has a legitimate interest in an engaging auditory design of the website. The consent can be revoked at any time.

For more information, please refer to Spotify's privacy policy: https://www.spotify.com/legal/privacy-policy/.

If you do not want Spotify to associate your visit to this website with your Spotify user account, please log out of your Spotify account.
